Terms and Conditions

1. Payment Terms

a) Payment should be made in favour of Templar Wines Ltd to the schedule detailed above. The seller reserves the right to charge interest at 4% per month (or pro rata daily) compound on all sums outstanding for the period between the due date for settlement and the date on which payment in full is actually made, the same being without prejudice to the Seller’s rights to pursue such outstanding sums at any time after the due settlement date.

b) If the buyer fails to make payment on the due date then without prejudice to the sellers other rights, they may, cancelor suspend deliveries of any goods due to the buyer.

c) Any cheque requiring re-presentation will attract a charge of £25 per re-presentation. Any cheque returned for any reason will incur a charge of £50 per cheque.

d) The seller reserves the right to charge at cost, any third party costs incurred in the recovery, or attempted recovery of any unpaid invoices.

e) Late payment after the due payment date will incur an administration fee of £25

f) The buyer shall be deemed to have accepted Templar Wines Ltd terms and conditions merely by placing an order, by phone, email, in writing or verbally and then receiving goods.

g) Templar Wines reserve the right to charge for artwork and print costs of Wine lists in the event of a breach of our Terms and conditions of trade.

h) Failed Direct Debits will incur an administration and re-presentation fee of £25 per transaction.

2. Prices

Our prices are quoted duty paid delivered and excluding VAT they are subject to availability, market and duty fluctuations and foreign exchange rates.

3. Claims for breakages, pilferage and loss

a) All goods must be examined on delivery to the buyer and signed for by the buyer or a person authorised by him/her in such a way as to make the identity of the signer clear.

b) Any claim for breakages or loss must be notified to the Seller, and the carrier if applicable, in writing within three days of delivery, and any damaged goods must be held for inspection.

c) Claims for non-delivery of goods despatched by Carrier should be made within 10 days of the date of the invoice. Only claims made within the above conditions will be met.

4. Title of Goods

a) The goods shall remain the property of the Seller until payment of all monies due from the Buyer to the Seller have been made in full and until such payment the Buyer shall hold the goods and all other items incorporating the goods in a fiduciary capacity and as trustee for the Seller.

b) lf the Buyer sells the goods before the Seller has been paid in full, the Buyer shall hold the proceeds of sale on trust for the Seller, and such proceeds of sale shall be placed in a separate account at the Buyer’s banks in such a way as tobe identifiable as being in the beneficial ownership of the Seller.

c) In the event of non-payment by the Buyer by the due date, or on the appointment of a Receiver, Liquidator or Administrator over the Buyer’s affairs, the Seller shall be entitled, in addition to all other rights, to enter upon any land or premises where the goods may for the time being be stored and take possession of such goods.

5. Payment Methods

b) Payment by Cash, Cheque, Credit or Debit cards will incur a surcharge of 2%

c) GoCardless Direct debit

6. Wholesaling of wine

a) Wines are supplied on the strict understanding they are for consumption on or off the Premises and not for re-wholesale.

b) If any wine is purchased with the intention of re-wholesaling then:

i) Details according to the Government Alcohol Wholesale Registration Scheme (AWRS) must be supplied to Templar Wines in advance

ii) Templar Wines details according to Alcohol Wholesale Registration Scheme (AWRS) can be supplied to you by return

7. Invoicing and statements

a) Invoices and statements are sent electronically. Paper copies can be mailed at a cost of £1.50 including postage.
